Understanding Your Insurance Mitigation Responsibilities
9/10/2024 (Permalink)
Don't let the unknows of improper fire, water, mold and storm mitigation and restoration leave you stranded, pick SERVPRO of Mobile County.
Understanding Your Insurance Mitigation Responsibilities
Reading an insurance policy can be challenging, especially when it’s filled with legal jargon and complex terminology. One crucial section that deserves your attention is the mitigation of damages clause. This clause is a key component of all insurance policies and usually reads something like this: “Each indemnified party will take and will procure that its affiliates take all such reasonable steps and actions as are necessary to mitigate any claims under this section…”
A "mitigation of damages" clause in an insurance policy outlines the responsibilities of the policyholder to take reasonable steps to minimize or prevent further damage to the property after an initial loss event. Here’s a general idea of what such a clause typically includes:
Key Aspects of a Mitigation of Damages Clause
Duty to Mitigate:
- The clause usually requires the insured party to take reasonable actions to prevent additional damage after the initial incident. This means the property owner should act promptly to limit the extent of the damage.
Reasonable Steps:
- It specifies that the steps taken must be reasonable under the circumstances. For example, if a pipe bursts, reasonable actions might include turning off the water supply and moving items to prevent water damage.
Requirement for Immediate Action:
- The clause often stipulates that the insured must act as soon as possible. Delays in taking mitigation steps can affect the insurance coverage or the amount of compensation.
Obligation to Notify Insurer:
- The clause might also include a requirement to notify the insurance company of the damage and the steps being taken to mitigate it. This ensures the insurer is aware of the situation and can provide guidance or support.
Impact on Claims:
- Failure to adhere to the mitigation clause can lead to partial or total denial of the insurance claim. Insurers may argue that the additional damage could have been prevented if proper mitigation steps were taken.
Example Wording
While the exact wording can vary by policy and insurer, a typical mitigation of damages clause might read something like this:
“In the event of loss or damage, the Insured is required to take all reasonable steps to mitigate further damage. This includes, but is not limited to, taking immediate actions to protect the property from additional harm and notifying the insurer of the damage and mitigation actions taken. Failure to take reasonable steps to mitigate the damage may result in a reduction of the claim payment or denial of the claim.”
Importance of Understanding the Clause
Understanding and adhering to the mitigation of damages clause is crucial for ensuring that your insurance claim is processed smoothly and that you receive the coverage you’re entitled to. If you’re unsure about what constitutes reasonable mitigation actions, it’s wise to consult with restoration professionals or your insurance agent for guidance.
Why the Mitigation Clause Matters
When your property is hit by a fire, flood, or other disaster, the mitigation clause becomes highly significant. It means you, as the property owner, must take reasonable steps to prevent further damage. Ignoring this clause can have serious consequences, much like neglecting medical treatment can affect insurance claims for a car accident injury.
Common Pitfalls in Mitigation
- Failure to Tarp Roof Damage: One property owner did not cover a damaged roof, leading to further water damage. The insurer denied coverage for the additional damage because the owner did not take immediate action to mitigate the problem.
- Neglecting Vehicle Protection: Another commercial property owner left vehicles near a damaged wall. When the wall collapsed, the insurance claim was denied because the owner could have moved the vehicles to a safer location.
- Disagreements Over “Reasonable” Actions: In some cases, insurance claims are refused due to disagreements over what constitutes “reasonable” mitigation steps.
Typical Mitigation Steps Property Owners Can Take
- Flood Situations: If a pipe bursts and floods your home, you can likely turn off the main water supply and move valuable items to higher ground to prevent further damage.
- Roof Damage: For storm-damaged roofs, it’s important to protect your inventory, prevent additional weather damage, and secure the property against potential burglary.
- Safety First: Property owners are not expected to take actions that are unsafe or beyond their capabilities.
Why Professional Help is Essential
Determining what constitutes “reasonable” mitigation steps can be confusing, especially in the aftermath of a disaster. Emotional stress and trauma can further impair decision-making. That’s why it's crucial to call in professional mitigation and restoration services as soon as possible.

They understand exactly what steps need to be taken to comply with these requirements and ensure that damage is addressed effectively. Fall Increase in Property Claims
9/22/2020 (Permalink)
September 22 is the first official day of fall!
Did you know that each year, September 22 is officially the First Day of fall here in the U.S.?
Did you know that each year, September 22 is officially the First Day of fall here in the U.S.? Also known as the autumnal equinox, it is one of only two days when the sun is directly above the equator dividing night and day into exactly equal portions. The other day is the spring or vernal equinox. Did you know that the beginning of fall also means a noticeable increase in the number of homeowner’s insurance claims? Claims that tend to rise as the weather turns cooler include:
- THEFT - Home robberies increase by 25% as the leaves begin to change. You can protect your home by keeping lights on a timer or using a motion detector. Installing video cameras that are accessible by an app is a cost-effective way to monitor your property when you are away from home. You should also make sure to store valuables like jewelry in a safe or safety deposit box.
- FIRE DAMAGE - Fire and smoke damage claims also increase due to the use of grills and fireplaces. According to gov each year home fires cost 2,500 people their lives and cause over $7 billion in property damage.
- WATER DAMAGE – Freezing pipes and water damage account for nearly 20% of all property claims during the last quarter of the year. Be sure to insulate exposed pipes and shut off the main water supply before going out of town.
As we move into fall, take some time to inspect your home. Making small fixes now could save you a headache down the road. And remember, we are always here to help should you need us. At SERVPRO of Mobile County we are available 24/7 to make it “Like it never even happened.”

Coronavirus - Fighting the Spread
7/15/2020 (Permalink)
Many hand sanitizers have been designated by the FDA as having possibly dangerous effects on your health.
At SERVPRO of Mobile County, our essential employees are out there everyday fighting the spread of COVID-19. We take every precaution and follow all CDC guidelines to ensure the most effective cleaning process while protecting our employees. In accordance with protocol, our technicians utilize necessary PPE (personal protective equipment) on each job site and we strictly adhere to proper donning and doffing procedures. There has been some controversy regarding what cleaning methods are effective (such as fogging only); however, one area that has not been debated is the efficacy of proper handwashing and sanitizing routines. Using hand sanitizer often is of the best ways you can protect yourself and prevent the spread of the virus. In addition to following stringent PPE protocols, we strongly encourage our technicians to use hand sanitizer often throughout the day. We visit multiple job sites throughout the course of our day and taking extra measures can not only protect our team but help to protect our customers as well. In June of 2020, the FDA released a list of hand sanitizers that contained significant amounts of methanol and should not be used. Methanol has potentially harmful side effects including nausea, headaches, dizziness, seizures and even death in some cases. Since the release of the initial list, there have been numerous updates. You can keep up with this ever-evolving list by CLICKING HERE. You should also always check your product labels and toss out any hand sanitizer containing methanol.

Over the past four years, the operation has nearly doubled their number of employees and experienced exponential growth. As they grew, the family-run operation transitioned from operating out of multiple locations to running under one roof. In 2018, Ray began to transition out and retire, selling the Southwest Mobile license to T. John. The dynamic brother duo forged ahead, adding new service lines and continuing to expand their business. Through hard work and determination, they were able to quickly meet all the necessary requirements and receive approval from SERVPRO to operate under one consolidated franchise name. We are happy to announce that moving forward, we will simply be known as SERVPRO of Mobile County! One name, one purpose…Serving our community to the best of our capabilities and always being here to make it “Like it never even happened.”

What To Do Until Help Arrives
11/9/2019 (Permalink)
Despite your best efforts to learn and implement precautions to prevent a water damage, it is often out of your control. At SERVPRO of Mobile County, we often talk about preparedness tips to prevent or minimize the impacts of a water loss situation. But we also want you to understand the best ways to reduce the impacts after the damage has occurred. Before doing anything, you need to make sure that the home is safe to enter. After a catastrophic flood event there may be electrical hazards, structural safety issues and contaminated water present. However, after a water loss due to burst pipes, leaking water lines or other household causes, your first step would be to locate and stop the source of the loss. Wipe wood, furniture or other belongings to remove excess water. If possible, place styrofoam or wooden blocks underneath furniture to prevent it from sitting in standing water. Relocated smaller contents to an unaffected area of the house. Move any rugs or floor coverings as well. At SERVPRO of Mobile County, we guarantee that a first-responder will be on-site within an hour to evaluate the situation. A crew will arrive on-site to begin mitigation work within 3 hours. Until help arrives, utilizing these tips could help you minimize costs and save contents after a water loss.
SERVPRO Serves: Feeding Firefighters
11/8/2019 (Permalink)
At SERVPRO of Mobile County we are proud to serve the Mobile area and we want to honor those who give so much to take care of our community. From this desire to give back, we developed our SERVPRO Serves: Feeding Firefighters program in 2016. As part of this program, we draw two lucky fire stations each month to receive lunch on us! This year, we decided to expand our reach to include municipalities in the greater Mobile area. We also kick it up a notch each December by providing home-cooked holiday dinners to four fire stations. We whip up holiday meals complete with all the trimmings to show our appreciation, but we feel like the ones receiving a gift. It is so awesome to build new relationships and get to know so many of our brave local firefighters. We love providing them with a small token of our thanks and hope to see this program continue to grow and thrive in the future.
